Join Eric and I as we discuss the best ways to work with a Contractor to ensure a successful relationship (and project). Listen to the Audio Click to Watch Show Notes: Contractors are oftentimes the last people to become involved in any construction project, and in some cases will end up doing all the heavy lifting. The architectural and construction industries both play a critical role in a building project. Contractors are responsible for putting together the physical pieces of the puzzle that bring an architect’s vision to life. Contractors come in to take an Architect’s vision and create the physical structure. A positive relationship between the architect and contractor is important because it helps the construction project flow smoothly from start to finish. When contractors and architects develop a positive relationship and communicate effectively, disagreements can be minimized (if not avoided altogether) and the project can move efficiently from one phase to the next. It might even make you a better Architect! A negative or adversarial relationship could mean: delays, poor communication, increased liability or worst of all, legal disputes. Top 5: 1. Contractors are building professionals too. Be part of a Team, not adversaries. View the Contractor as a vital part of the design project team (cause they are!) Don’t view the Contractor as a hired hand, but as a building professional bringing their expertise to the project like everyone else. 2. Contractors need information. Communicate, and then over-communicate. The key to any successful architect-contractor relationship is open, honest communication and a mutual respect for one another. Contractors should take strides to keep the design team informed on a regular basis throughout the construction process to avoid confusion and minimize mistakes. Likewise, architects should be open to the reality of the situation in the field. Drawings aren’t perfect. Sometimes Contractors find conflicts (REMEMBER: drawings and specs are complementary). Sometimes they have questions. Questions are good as they show interest and a desire to make things correctly. Communication is key to an effective working relationship between an architect and a contractor. It’s important to hire a contractor who has many years of experience working with architects on building projects ranging from home additions to large commercial construction projects. Without good communication, the project can lose focus and desires of the property owner may be lost. At the beginning of the project, the architect and the contractor should have a conversation to understand and agree upon how changes will be tracked. Don’t schedule contractor meetings at 6pm (they like to start early and end early,.) 3. Contractors have specific responsibilities. Trust your roles. Architect has a lot of responsibilities during construction: Change Orders Application for Payment Review Shop Drawings Design complies with building code Certify date of Substantial Completion Approve Notice of Final Completion & Final Application for Payment But so does the Contractor: means and method of achieving the design in the Contract Documents paying their subs / release of liens manage inspections submit RFIs Punch Lists Schedule of Values The General Contractor is also responsible for selecting Subcontractors (framing company, painting crew, millworkers, plumbers, etc.). The General Contractor ensures that the Subcontractors perform work as described in the Construction Documents the Architect has prepared. The General Contractor also coordinate schedules and deliveries, answer questions onsite, review shop drawings, and alert the Architect when more information is needed. The AIA documents are specific in describing documentation provided by the contractor, and the architect is wise to capture that documentation in the record files. 4. Contractors care about their portfolio too. Let them be enthusiastic about the project. Great contractors take pride in their work and want challenges too. If you’re working on a LEED Platinum project, or a project with a tricky facade detail, or something unique, expect and enjoy a contractor that gets excited about working on such cool things. Share the costs of the photos. Mention them in the marketing and PR of the project after it’s done. (You hate when articles fail to mention the Architect, don’t you?!) Expect to work with them again. Great contractors are invaluable. In San Francisco, I have the same stable of 5 Contractors I used for most jobs (City, East Bay, South Bay, Marin). 5. Contractors are better business people than you, probably. Listen to the Audio Click to Watch Show Notes: Due to the complex nature of architecture projects, a number of factors can make or break an architect-client relationship. 1: A good client relationship is about Trust Trust is the foundation of any relationship between architect and client, and cultivating trust has huge benefits: repeat clients, patience when challenges arise, and referrals to new clients. But a weak or eroded sense of trust can harm your reputation, cost you future business, and even drive clients toward litigation. So how do you build trust? a. Be transparent about everything. deadlines, good news and bad, b. Show you are listening to them. Take notes, and highlight how their input shaped the design. Point out the things they asked for and use their needs and requests to talk through the design. c. Offer New and Creative Solutions to their problems and for their needs. d. It’s about them, not you. Don’t make it about “your vision” but about fulfilling their needs. e. Underpromise, and overdeliver. Say you’ll give them 2 schemes and provide 4. Don’t Overpromise ever. Hard when they pressure you. Be Honest in Setting Expectations. Show conviction and maintain integrity Trust is built on consistency f. Trust goes both ways. If you’ve done everything to earn their trust and they still don’t trust you, they have the problem. 2. Even great clients don’t always agree. Couples argue, boards disagree. Sometimes your job will be as a marriage counselor. 3. Your process may not be their process. Be flexible. You may have a certain way of selecting fixtures, or insist on sticking to a certain style of meeting agenda, but clients are all unique. Know when 4. You need to protect them and be a professional too. Tell them when they are wrong. No, they can’t build a 5000 square foot house for $100k. No, you can’t avoid getting a building permit. No, you can’t use an unlicensed contractor (or some guys down at the U-haul parking lot). 5. The relationship shouldn’t end when the project ends. BONUS: CLIENT WARNING SIGNS: I automatically disqualify any potential clients who: 1. Use the word “lawsuit” in our first meeting. 2. Want to control the construction process with an impossibly rushed schedule. 3. Is verbally abusive to their spouse/children during the first meeting. 4. Already had an architect they fired. 5. Treats the waiter poorly at our initial lunch meeting. 6. Was divorced in the last year and is getting their “life back together”, or hopes this project will “save” their marriage. 7. Listen to the Audio Click to Watch Show Notes: QUOTE: Benjamin Barber, an eminent sociologist, once said, “I don’t divide the world into the weak and the strong, or the successes and the failures… I divide the world into the learners and nonlearners.” OVERVIEW: Today we’re going to talk about MINDSET and how your mindset might be preventing you from passing the ARE. what if YOU are the reason you’re not passing the ARE? You know the material, have a few years of great experience, but yet you’re still not passing and you don’t know why. listening to hundreds of candidates. I can now tell you which will pass and which won’t. Not magic, just but their approach to learning, their “Mindset” How can you use your mindset to help you pass the ARE? Eric read book by Carol S. Dweck, PhD? called Mindset: The New Psychology of Success. How can you apply this to your studying for the ARE? Examples: failed an exam she thought she aced. Took it again with renewed enthusiasm and passed with all Level 1’s on score report. She was surprised. has taken the same exam 11 times and failed 11 times. Keeps blaming the “system” failed cause they were sick that week, but didn’t reschedule the exam. blames the rolling clock, the computers at the testing center, the deadlines at work, the study guides! here’s some tough love: YOURE THE PROBLEM! Or namely, your mindset is wrong. 1. FIXED vs GROWTH MINDSET Everyone is born with an intense drive to learn. Infants stretch their skills daily. Not just ordinary skills, but the most difficult tasks of a lifetime, like learning to walk and talk. They never decide it’s too hard or not worth the effort. Babies don’t worry about making mistakes or humiliating themselves. They walk, they fall, they get up. They just barge forward. But as people age, they fall into the “fixed mindset.” Fixed mindset means you expect yourself to get it right the first time, to be perfect, to do it right away too. In short, you’re afraid of learning and afraid of making mistakes. BUT making mistakes is how we learn. Change from a fixed mindset, to a “growth mindset” 2. ATTITUDE MINDSET example of candidate who hates NCARB, hates the format, hates the testing center. 3. CHANGE YOUR MINDSET 3a. Focus on Learning Over Achievement Accept that these exams are hard and you will struggle Instead of depending on luck or “natural” talent, you focus on developing your skills and abilities, and learning from your efforts. 3b. Change your Mindset Even a fixed mindset is not a fixed thing! Change it. Just by knowing about the two mindsets, you can start thinking and reacting in new ways. As you approach a challenge: THE FIXED-MINDSET says “Are you sure you can do it? Maybe you don’t have the talent.” THE GROWTH-MINDSET answers, “I’m not sure I can do it now, but I think I can learn to with time and effort.” FIXED MINDSET: “What if you fail—you’ll be a failure” GROWTH MINDSET: “Most successful people had failures along the way.” FIXED MINDSET: “If you don’t try, you can protect yourself and keep your dignity.” GROWTH MINDSET: “If I don’t try, I automatically fail. Where’s the dignity in that?” As you hit a setback: FIXED MINDSET: “This would have been a snap if you really had talent.” GROWTH MINDSET: “That is so wrong. Basketball wasn’t easy for Michael Jordan and science wasn’t easy for Thomas Edison. They had a passion and put in tons of effort. As you face criticism: FIXED MINDSET: “It’s not my fault. It was something or someone else’s fault.” GROWTH MINDSET: “If I don’t take responsibility, I can’t fix it. Let me listen—however painful it is– and learn whatever I can.” Over time, which voice you heed becomes pretty much your choice. Whether you take on the challenge wholeheartedly, learn from your setbacks and try again hear the criticism and act on it is now in your hands. 4. APPLYING THIS TO YOUR CAREER Is there someone in your office, maybe an older or career person who seems stuck? At some point they got “good enough” at their work and just stopped? You want to avoid that. Be a lifelong student. Be willing to try new materials, new systems, new approaches. Whether in your design projects, or how you manage those projects. But when you step back and look at the bigger picture, Architects can have a big impact on the environment simply by the material choices we make. Eric and I discuss the state of materials used in our buildings today as well as give you solid advice and the six questions you should ask every Sales Rep that you come into contact with. Listen to the Audio Click to Watch Show Notes: Materials change the world think what stone did for the Ancient Egyptians or how steel was forged into swords for armies or even into girders for skyscrapers in turn of the century Chicago think of how dimensional lumber allowed expansion of suburbia 1950s: post world war II launched the age of the Petro-Chemical industry which spawned the chemical and toxins revolution. 1962: Rachel Carson’s book, Silent Spring, launched the environmental movement. In early 1960s a woman’s lifetime risk of breast cancer was 1 in 20, today it is 1 in 8. 1970: EPA founded (Earth day and Clean Water and Clean Air acts) 1971: President Nixon signing cancer act of 1971 1976: Toxic Substances Control Act (TSCA) – President Ford signed EPA has the burden of proof on what is toxic/dangerous and in 40 years they have only banned 5 chemicals, but 1500+ new ones released every YEAR. 1980: sick building syndrome 1985: California Prop 65 to control toxins in buildings 1989: banned asbestos and lead paint (decades after lawsuits and health effects felt) 1990 – Today: American Chemistry Council lobbies Congress (last year they spent $55MM) Chemicals in use and their direct health effects: Environmental Working Group tested umbilical cord blood for 300 chemicals and found 287, including Teflon, ScotchGuard, and fragrances, containing: * phthalates * endocrine disruptors * known carcinogens We are quietly becoming genetically modified by toxic chemicals. People assume that if a product is sold, its safe, but NO ONE has tested it and NO ONE is allowed to know whats in it. We were sold the dream of “better living through chemistry” but never checked the health consequences. There are now 80,000+ chemicals on the market, making it impossible to sift through, and the EPA lacks the authority to properly regulate the chemical industry. Chinese manufacturers have two versions: highly regulated version for EU and China and cheap toxic versions for the US market This is not a secret: everyone in the building and health industry knows about this broken system FDA guidelines haven’t changed since they were enacted in 1938 Air pollution exposure is an invisible hazard responsible for seven million premature deaths every year, according to World Health Organization estimates. Regulations have been slow and corrupted so it’s pushed us toward transparency TOPICS COVERED IN PODCAST: 1. What is Lifecycle Assessment (LCA)? 2. QUESTIONS TO ASK SALES REPS FOR TRANSPARENCY 1. Where did this material come from? 2. What are the by-products of its’ manufacturer? 3. How is the material delivered and installed? 4. How is the material maintained & operated? 5. How healthy are the materials? 6. What do we do with them once we are done with these materials? DEALING WITH SALES REPS 1. they want your sale, so make them work for it 2. use your questions to have them educate themselves 3. invite them back to give a lunch and learn once they are able to answer those questions 4. mfrs listen to you (their customers) so YOU need to push them for transparency 5. make it clear this is important to you and the firm DOCUMENTARIES MENTIONED: Stink! Eric and I discuss how the skills we learned in architecture school can help us succeed in life, both professionally and personally. We discuss problem solving and the ability to accept criticism as two key components that can be applied to the real world. Listen to the Audio Click to Watch Show Notes: How to handle criticism: Listen (record or take notes): the crit is designed to help you. Use it! Focus: it’s not about YOU. Don’t take it personally. Repeat it back (active listening): so they know you were listening, and you confirm you heard it right Engage: ask questions (i.e.: So, I was thinking of this other approach… would that have worked better.”) Trust: assume they had good intentions. An occasional sadist in the jury would be offset by the other jurors. Body Language: open arms, open face, open mind. Don’t get defensive: that includes not making excuses. Take control of the conversation by admitting the mistakes you just realized, or ways you could have approached it better. You can disagree: you don’t have to agree with everything said, but you do have to consider it (don’t reject it outright) Gratitude: be grateful for their time and feedback. Change is constant.” – Benjamin Disraeli A lot of buzz has been happening within the last couple of months about NCARB’s new ARE 5.0 hitting the streets in late 2016. In this episode, we discuss the overview as well as a strategy to transition from 4.0 to 5.0 that includes taking only 5 of the new 6 exams. Listen to the Audio Click to Watch Show Notes: DETAILS: The existing ARE 4.0 consists of 7 divisions: Construction Documents & Services Programming, Planning & Practice Site Planning & Design Building Design & Construction Systems Structural Systems Building Systems Schematic Design The new ARE 5.0 will consist of 6 divisions which will include: Practice Management Project Management Programming & Analysis Project Planning & Design Project Development & Documentation Construction & Evaluation WHAT: 6 all new exams The future exam will include six divisions, and each will be standalone, single test administrations. This structure results from an effort to align the ARE with the more commonly defined professional architect activities of practice management, project management, and project design. each division will cost $210. WHAT THIS MEANS FOR EXISTING CANDIDATES (underway with ARE): No vignettes: The new structure incorporates graphics throughout the exam via new “performance item types” that have candidates perform exercises similar to what an architect does as part of regular practice. Additionally, the incorporation of case studies is anticipated to be implemented in all proposed divisions and will allow more in-depth analysis of architectural scenarios by candidates. BUT GRAPHIC QUESTIONS: The division structure for ARE 5.0 incorporates graphics throughout the exam through new performance item types like hot spots AND CASE STUDY QUESTIONS: based on a set of drawings You can take both versions of the exam: Dual delivery means that both ARE 4.0 and ARE 5.0 will be offered at the same time. Candidates who started in ARE 4.0 will have at least 18 months after the launch of ARE 5.0 to finish in that version before they are transition to ARE 5.0. However, candidates who started in ARE 4.0 will have the option to choose to start testing in ARE 5.0 anytime after it launches. You decide when to switch from 4.0 to 5.0 (but you can never switch back) The last day ARE 4.0 will be available in test centers is 30 June 2018. After this day, any remaining ARE 4.0 candidate will be transitioned to ARE 5.0. They offer a ARE 5.0 Transition Calculator to see which of your existing exams map to the new 5.0 exam. WHAT THIS MEANS FOR NEW CANDIDATES? (should you wait?) ARE 5.0 will not be easier or harder than ARE 4.0. It is going to be different. The rolling clock is still in effect: Before you can decide on how you should test going forward, you need to review your Rolling Clock dates. ARE 4.0 division expiration dates based on the Rolling Clock will remain in effect for the transition to ARE 5.0. The earliest expiration date of any ARE 4.0 division(s) used to create an ARE 5.0 credit will be applied to the credit. Keep testing in ARE 4.0! The average candidate finishes the ARE in two years—meaning most candidates currently testing will be done with ARE 4.0 before ARE 5.0 even launches. TAKE 6 EXAMS FOR THE PRICE OF 5 focus on passing three critical divisions in ARE 4.0 Construction Documents & Services Programming Planning & Practice Site Planning & Design equate to 4 version 5.0 exams If you pass these three divisions in ARE 4.0, you will only need to take two additional divisions in ARE 5.0 you could finish the ARE in only five divisions SEE: http://www.ncarb.org/ARE/~/media/Files/PDF/Brochure/ARE5_CreditModel.ashx WHY THE NEW UPDATE? Why are they doing this to me?! The Council updates the exam every 6-10 years to ensure that it aligns with current practice. These divisions are a change from the current seven division structure in an effort to align the divisions of the ARE with the more commonly defined professional architecture activities of practice management, project management, and project design. The proposed direction for ARE 5.0 was informed by: Multi-year efforts by the Research & Development Subcommittee with additional support from the Graphics Grading Subcommittee Expert psychometric advice Research conducted by a multi-disciplinary staff project team Emerging technology, including interviews of industry leaders Results of the 2012 NCARB Practice Analysis of Architecture WHEN AVAILABLE? Listen to the Audio Click to Watch Show Notes: Today we discuss how to identify and set goals. Why does the New Year trigger new resolutions? A chance to reflect and start fresh. A successful career in Architecture doesn’t happen by luck or by chance. It requires a clear vision of what you want, setting tangible goals, and then assigning tasks to work toward those goals. PASSING THE ARE (from Aubrey’s article Make a New Year’s Resolution…To Become Licensed! ) – Make a visual aid – Get family & friends involved – Stay positive All 3 of these tips are about committing to something and holding your feet to the fire. 168 Hours There are 168 hours in a week. Assuming you sleep 7 hours a night (and you should), that leaves around 119 hours. If you’re working a full time job at a firm, there goes another 40-50 hours (not counting lunch or commute times) bringing you down to 69 hours. Adding in time for bathing, grooming, eating and other necessities, you’re down to (maybe) 55 hours a week. That free 55 hours seems like a lot, doesn’t it? Yet why do you feel so strapped for time? It’s because you lack focus and clear goals. It’s because you don’t make a plan for your time and get distracted. It may come from mom or dad, a cousin, or long lost relative. When you’re in architecture, word travels among your family and you’ll soon hear from Uncle Al who needs a new deck designed. But the question is, should you do it? The decision to moonlight has several ramifications. You could find yourself in deep trouble or in the beginnings of a great start to opening your own firm. It is not to be taken lightly and can have serious consequences, especially if you’re doing it without your firm’s permission. Before taking on any moonlighting work, be sure to listen to this episode. It could prevent you from making several fatal mistakes. Run the risk of exhausting yourself and getting your firm and co-workers in trouble Everyone thinks about it but you need to know the full story CONSIDERATIONS Most firms that have policies in place against moonlighting MAY allow exceptions for projects that benefit family members WHAT TO CHARGE You will have taxes to pay, so it should be about 3x your current hourly rate (varies) LEGAL ISSUES Work may be construed by the client (and the client’s attorney) as being produced under the supervision of the firm, thereby exposing your firm to liability by association for any of your negligent acts If you use firm resources, like copiers, Fax’s, cad equipment, and advice from office peers. Firm policies could get you fired (no-moonlighting policies—but that never stopped anyone) Attorney looks for the bigger fish WHY YOU? Do they love you or your work What will doing this do do for you (know your reasons why) NO NO’s Don’t practice unlicensed or hold yourself out as licensed if you’re not Don’t use your company’s equipment (liability) Don’t exhaust yourself Don’t involve your co-workers or trust them to keep it a secret But never lie if caught Don’t do this work without a contract (just cause you’re doing it on the side, doesn’t change the requirements) Liability insurance (especially if its your first jobs) – errors and omissions (E&O) PROS to MOONLIGHTING Launch your own practice Make more money No startup (code books, plotters, and more) Will help you discover why you’re looking (you should have been fulfilled by your job, right?) No matter when you decide when you want to be come an Architect, we lay the path for you (albeit a long and sometimes windy one). We discuss the 4 main steps of licensure, from Education to Licensure. Education 2. Internship 3. Examination 4. Licensure 1. Education Accredited by the National Architectural Accrediting Board (NAAB). Students should visit the Association of Collegiate Schools of Architecture website (ACSA) to access A Student’s Guide to Education including information on architectural education, becoming an architect, and selecting a school. Each state’s architectural registration board sets it’s own standards, so graduating from a non-accredited program may meet educational requirement. Three types of professional degrees in architecture are available (from NCARB’s website ): Bachelor of Architecture: Accredited degree programs awarding the B. Arch. degree must require a minimum of 150 semester credit hours, or the quarter-hour equivalent, in academic coursework in professional studies and electives. Master of Architecture: Accredited degree programs awarding the M. Arch. degree must require a minimum of 168 semester credit hours, or the quarter-hour 10 equivalent, of which 30 semester credit hours, or the quarter-hour equivalent, must be at the graduate level, in academic coursework in professional studies and electives. Doctor of Architecture: Accredited degree programs awarding the D. Arch. degree must require either an undergraduate baccalaureate degree or a minimum of 120 undergraduate semester credit hours, or the undergraduate-level quarterhour equivalent, and a minimum of 90 graduate-level semester credit hours, or the graduate-level quarter-hour equivalent, in academic coursework in professional studies and electives. Education Evaluation Services for Architects – EESA The NAAB’s Education Evaluation Services for Architects (EESA) program enables you to have your non-accredited degree assessed to determine if it meets the NCARB Education Standard for licensure and identify what, if any, deficiencies remain to be satisfied. NOTE: The Bachelor of Science in Architecture is not a NAAB accredited degree. (just B. Arch and M. Arch). 2. Internship Intern Development Program – current program is 3,740 hours, dropped from about 5600 hours. National Council of Architectural Registration Boards . 3. Examination Architect Registration Exam: 4.0. – 7 exams. Architect Registration Exam: 5.0 coming late 2016 – 6 exams. California Supplemental Exam – Supplemental required by California after completing the ARE. 4. Licensure Check with State that license will be obtained for requirements. Granted by the State where candidate is seeking licensure. 54 Jurisdictions: 50 states plus D.C., Guam, Puerto Rico, Virgin Islands.
